Law Offics of Joseph H. Nivin

I have extensive experience in all aspects of Family Court litigation, having appeared daily in Queens Family Court for my entire legal career.  As a Family Court attorney, I represent both adults and children in cases involving custody, orders of protection, child abuse and neglect, paternity, and child support.  I help victims of domestic violence to protect themselves and their children from physical and emotional abuse.  I help grandparents to protect their relationships with their grandchildren.  I regularly handle cases involving allegations of parental alienation.

As a child custody attorney, I believe that nothing is more important than making sure that children are safe and well-adjusted.  I understand that custody cases are both frightening and humiliating.  I work diligently to minimize the emotional and economic toll of custody litigation.

As a child support attorney, I have experience obtaining initial child support orders and modifications of child support.  I also handle petitions seeking enforcement of child support orders.  I understand the importance of making sure that children receive the support that they deserve, and I work hard to protect the financial well-being of my clients and their children.  I also understand the frustration of people who have child support orders that are not being followed.  I represent clients in actions to collect child support that they are entitled to.

As a divorce attorney, I have experience representing both adults and children in Supreme Court matrimonial proceedings.  I handle cases involving maintenance, equitable distribution, child support, and child custody.  I am available to represent people in both contested and uncontested divorces.  I use every tool available to protect my clients from suffering financially as the result of divorce, and to ensure that my clients receive their fair share of the marital assets.  As always, I work tirelessly to protect the well-being of the children of the marriage.

I began my career as an attorney for the Administration for Children’s Services (ACS), prosecuting allegations of child abuse and neglect.  In custody cases where ACS becomes involved, my experience as an ACS attorney gives me a unique ability to help my clients.  I also have experience representing foster parents in Family Court proceedings.  Furthermore, I represent people who are challenging “indicated” determinations by their social services agencies, and people who are facing charges of child abuse and neglect in Family Court.

I authored “The Jurisprudence of Parental Alienation,” and “When Domestic Violence Constitutes Child Neglect- Judicial Analysis of Impairment within the Meaning of Family Court Act §1012(f)(i),” which were published in Electronically-In-Touch.   I recently authored the chapters on Family Offenses and Child Protective Cases in Onward & Upward: Guide For Getting Through New York Divorce & Family Law Cases.  I spoke at a Continuing Legal Education seminar in June 2014 at the Queens County Bar Association, entitled The Changing Juvenile Delinquency Practice: The "Close to Home" Placement Initiative.

I was named a Rising Star in 2015 by Super Lawyers Magazine, and I received the 2015 Client Satisfaction Award by the American Institute of Family Law Attorneys.

As proven by my reviews on Google, Avvo, and Facebook, my clients are consistently satisfied by my representation.  I am responsive, hardworking, and committed to my work.  I understand that I am dealing with people’s lives, and the quality of my work reflects that.

I am approved by the Appellate Division, Second Judicial Department to represent indigent people in Family Court cases at the trial and appellate levels.

You can read more about me on my website. I look forward to being of service to you and to your families.
